I have applied I485 when i was in India and it is in pending now.I am back from India and currently in USA now and came to know that one cannot file I485 when the applicant is not in USA.
Should i be withdrawing the pending I485 and reapply now ?since there is a date availability till august 17th 2007
Or Can I appply new I485 without withdrawing the pending I485 .Once I get new receipt notice ,then withdrw the old pending I485?
Please suggest .Thanks in advance.

My H1 Extension approved from Sept'2010 - Dec 2012. LCA shows same dates and the salary shown is $5500 PM ($66000 P.A)
However recently, i noticed that i am receiving $5373(instead of $5500) per month since Sept'2010 till date.
I informed to my employer and he is willing to increase the pay from March.
Is it possible to correct it from March payroll.
Please advise.

The employer should correct it from March and pay the 6 months difference as bonus. At end of year your salary should be at least equal to LCA.

Hello,
Not that I know ... the worst case scenario is that your green cards are physically mailed to you and then they are returned 'cause nobody was at the home (though normally, it should just sit with your other mail).
When you reenter US, stand in the regular visitor line.... if your card is issued, the IO will know and stamp your passport w temporary green card and allow you in the US.

I have used AC21 twice. I did send a letter to USCIS for my first move. i have not sent any letter for my second move. Most of the attorneys i consulted are saying it is not necessry to file for AC 21 unless you feel the employer can jeopardise your green card.
There is no rule for filing AC 21. If you get an RFE, they will request the specific document they need. If you are following the rules, then you should be able to provide whatever they request in the RFE.

If anyone is planning to drive from CT for the rally or is not driving because they are unsure, or not motivated enough... then here is your chance.
We can join together and go to DC and come back together. I am planning to go on Monday 17th morning. Ill be coming from New Haven/Hamden area in CT.
If anyone is planning to go in the evening, we have a BUS service available also. We are starting 6:30 PM from Woburn, MA on the 17th and should be reaching Hartford at around 8:15 - 8:30 PM, New Haven at about 9:00 - 9:15 PM.

my name was not interview with my family.
my family gave interview and embassy asked for original I140 and I824 approval notices to check my eligibility.
i submitted and now after 2 weaks got the follwing reply:
In your case , the I-140 was filed on sept 10, 2001 and approved on october 08, 2003. The visa became available on october 08, 2003 . Form I-824 was not filed within one year of visa became available. <my name> was born on January 03, 1986. because he (me) is above 21 years old an immigrant visa as a derivative beneficiary of Employment third prefrence (e3) immigrant visa category cannot be inssued to <my name>. In order to qualify for a visa, he (me) would need to benifit from CSPA. Since form I-824 was not filed within one year of visa becoming available on October 08, 2003.
<my name> cannot be processed under CSPA.
but i think and i am not sure if i am right or wrong that I824 can be filed after issuance of green card, but at that time my dad ddnt got green card.
SO plz help me with right advice and solution so that i can travel with my family.
my mom and bro got te visa and it will expire in 6 monts and i want to go with them, can i be able to get visa in any case before their visa expire?
i badly need help.

Your H1B is tied to your current company. If your new employer wants to hire you, they have to file a separate H1B for you.

I have to agree that the back ground is a bit distracting, but the petal is a very cool shot. If this were my shot I would try a few things in Photoshop to change it up. I am a registered professional civil engineer in the state of PA having an educational background of a BS from India and MS from the US in civil engineering. I got my H1B extension approved last year for its second term of three years. I have been working in the same company since my graduation and also hold an approved I-140. I am planning to visit India in March to get my visa stamping done and am concerned about the reports of valid H1B holders being returned from Newark. Do you think I should avoid Newark as the PoE?

yes, I have done that. I had visa stamp of Company A and I was working for Company B. please note that the visa stamp of Company A was not expired when I entered US port of entry. At port of entry, I showed the H1 approval notice of new employer. Please make sure that they stamp the expiry date in your I-94 based on your new approval notice of Company B. that is very important.
