I'm hoping someone can provide some good advice...
My grandmother renewed her green card application January last year, got fingerprinted and was told she was all set. While she was out of the country in June, she received notice that her prints had to be retaken and her appointment was in 10 days.
Being 90 and not in the best of health, she did not go back to the US with such short notice. She tried to call the UCSIS hotline to reschedule and was told she could not and that she had to go into the local office to do so (though the whole point was she in Asia).
I was only told this recently by my parents and tried to find some solutions for her as the main reason she came to the US in the first place was to help raise me.
Looking over her denial notice, it appears she could reopen the case with supporting evidence. But am wondering what I need to provide and if there's anything I can do?
Any suggestions?
Also, it looks like if you are 75 years old or more you do not need fingerprints but is this only for the naturalization process or does it also apply to the PR process?
Any advice would be great!

My H1B visa end date is 30July2013(PED or expiration date in H1B visa stamp) and my I-94 end date is 10-Aug2013.But in I797B the end date is 30July2011. Can you please help me that i need to do my H1B visa extension within 30July2011?....please clarrify that visa validity depends on I94 or Visa end date or I797B end date....thanks

Yes but I was thinking, spouse and children are counted in family based visas and how exempting them will benefit EB visas. Correct me if I'm wrong. :confused:
At present the dependents are counted in the EB cap...So the number 140K for EB is principal applicant+dependents combined...This bill exclude all dependents of EB from any cap...(But the country limits still apply I guess)...
FB and EB cap got nothing to do with each other..

One of my friend is in the same situation and he has been told by his lawyer that he can get his part-time concurrent H1 Extn for 3 years based on fulltime concurrent H1 approved I-140.
He is going to apply the same soon.

I applied for H1B and Green Card Simultaneously in 2002. My first H1B expired in 2005. I am working on EAD. My questions are--
If I decide to change jobs and apply for H1B with the new company, am I subject to the QUOTA?
If I change jobs( in similar field) to another state in another service center, how is my case transfered to TSC from NSC?
Please reply.

Hi. I am currently here in the US applying for AOS from a B2 to F1 visa. I sent my application on the 26th April with USPS Express mail request return reciept. My current 1 94 expired on April 28th. My return receipt from USPS says that my item was signed for on April 28th leaving me still in status but when I received my I 797 C it says that the receipt date is April 29th. I am very worried and I am wondering if this is something I should call their customer services department about. I do not want my application denied simply because I may seem not to be in status. Please help, I am very worried.

A brief background: I have approved labor (PD Jun04/EB3), I-140 rejected & pending I-140 (MTR filled in Jan'07) with attorney A. Meanwhile got PERM LC approved & filled I-140 & I-485concurrently in Aug.07 thru Attorney B (recipt recived).(FYI....the same company did Old & New PERM Labor)
Now the question is, If my old I-140 gets approved, than do I have any benefit/advantage using that Old approved I-140 PD of Jun04 when my new I-140 gets approved? In short, can I still use my OLD priority date? (Jun04).(even though I have already concurrently filled New I-140 & I-485 in aug.07).
Any thoughts/suggestions/advice/ideas are appreciated. thanks.

That actually is the right way to do it.. Once your project is done technically your H1 is expired and you need to return to your home country.
Yes, you can file for a transfer and travel anywhere you want but for reentry you will need the transfer notice or approval notice from the new company, which can be mailed to you. If you already have a visa stamp then just show the new approval (transfer) and they will let you come in.

It's not clear what you really mean.
You say your employer has agreed to file your AOS papers but has not agreed to proceed with the processing. Isn't that one and the same?
Besides you should ask for exactly what the risk is.
Maybe hiring your own immigration attorney or a consult is the best to get your facts straight.

hi everyone,
i wondered if someone could help me find answer to the following questions.
I am a Physician and currently in Residency program which is for 3 years. my residency ends on 30th September 2008 and i have H1b status. I have been offered Fellowship in my desired specialty but it starts on 1st January 2009, therfore there is a gap of 3 months between the end of my current job and beginning of my next job.
so my questions are:
1. H1 petition which I will file for my fellowship starting 1st jan 2009 would be an extension of my current H1 or would I have to file a new H1?
2. suppose I find a job for 3 months gap period at the same institution where I have got my fellowship (keeping in mind that decription of this job would be a little different from what i will be starting from 1st jan 2009), would i have to file for 2 different H1B petitions (one for 3 month period starting 1st oct 2008 and the other for fellowship starting 1 st jan 2009).
3.also, I was thinking that if I file for H1 approval say in july 2008 for the fellowship starting 1st jan 2009 and get approval by mid september 2008. with the approved petition I go back to India and have a vacation for 3 months and come back to US in late december 2008 on H1B again for Fellowship beginning 1st jan 2009. In this case, what would be my status for the gap period of 3 months that I spent in India?
also, would I be issued a new SSN when i come back again. also, i have heard rumors that US embassy in Delhi can hassle you to get H1. How true is that?
Is there any other option someone can suggest?
