I have a PERM filed on Nov 2006. and it is approved. Like most ppl here I also applied for I-140 & I-485 during July and got the receipts. I am looking to change companies using AC21 by next Jan but would like to keep my H1B active.
I have the following qns:
a. If I find a new employer(B) who is willing to transfer my H1B, will I get extension 3 yr extension beyond 6 yrs based on my current employer(A)'s PERM and approved I-140.
b. I know that 3 yrs extension is possible with approved I-140. Is it possible with new employer also (the one who has nt filed ur GC ? Also Is 3 yr extn possible after filing I-485 beyond 6 yrs?

After 12 months of toil I have finally completed the narrative and evidence that I need for an EB-1a (Extraordinary Alien) application. I ab about to complete the I-140 paperwork to go with it.
My questions is this - I have contacted a small number of Immigration attorneys who have quoted me approx $6000 for the whole process. How many of you value think that USCIS would look at my application more favourably if I used a reputed attorney rathen than putting in my own application and paperwork ?

USCIS will be interested in the content of the application rather than the reputation of the attorney submitting it. You are free to submit your own application if you are comfortable researching immigration laws required for your application.

Did u call USCIS customer service and raised a service request for not receiving FP?. If not I guess you need to do that
We filed for adjustment of Status in August 2006 and received EAd's and travel documents. We have not yet received fingerprint dates. Will it take this long? Any advise on how to deal with this?

I found out that it was RFE to get me credentials evaluations and copies of degrees. My employer has already sent those. Thanks for the response though.

I had a G lens for a year or so then one day it just stopped working, my D lens I bought used and it's still working today. Also a D70 owner. The G was cheap and ended up kind of being a disposable in some ways, it was cheap enough so I'm not out that much.

Nobody other than the USCIS will know, so if you get any any replies, do not believe them.
If you have waited like me for 6 years to get your Labor Certified, then be prepared to wait another 6 years for 140, even if your PD is current and watch others who filed 5 years after you get their GCs.
I urge IV to raise one issue at the DC Rally. Please please ask Mr. Chertoff to do away with this farce called "Priority Date". It is an useless concept and should be done away with immediately. Everyone knows that the GC process is totally random, so why have something known as a "Priority Date" when it is anything but a Priority Date.

Yes he can , but once 180 days of pending "I-485" are passed then you are free and protected by AC21.

My previously filed PERM & I-140 are under the verge of rejection due to a pending RFE.
I am planning to file another PERM. Even though I'm trying to do it ASAP, I'm wondering whether I have an advantage on filing new PERM before Dec 20th 2007.
While applying for H1B extension in Dec 2008, If I have an approved labor/pending I-140 I thought I could request for 3 year extension. If I don't have labor/I-140 pending I can only request for 20 months extension (as my 6 year H1B term ends on Sep 2010)
I read from a site that...
"One in H1B/H-4 status can extend to the end of the 6-year limit, and then take advantage of the provisions allowing extensions beyond the 6-year limitation, if the labor certification or I-140 was filed at least a year earlier."
When I asked this question to my attorney he said
You can file for an H-l B visa extension up to 6 years. You can only file for an extension past the 6th year if your labor certification and/or I-l40 was pending for more the 365 days prior to the 6th year on your H-lB Visa status. If not and your labor certification is approved and the I-l40 is pending then you can only request an extension in one (l) year increments only until a final decision is made.
So does this mean I can only request for a 12 month extension if labor/I-140 is pending on Nov 2008?
