I should say, compared to H1B, the risks of benching on EAD are far lower.
But I guess there is nothing concrete to prove that you are ok without pay if you work on EAD... so it's always good that your employer pay at least the labor wage if possible.

Vacation days can be counted in the 5 years. A leave of absence might not be able to be counted in the years of experience.

Me and my wife filed H1B extension through a company. I moved to consulting after my extension is approved. The consulting company filed my H1B transfer which is approved recently. Unfortunately my employer (the consulting company I moved to) dint file for my wife's H4 extension and he told that was not needed.
My question is can my wife with the petition approved from my previous employer to get her H4 stamped in India?

Make sure your spouse has valid AP on hand while she travel to overseas...so that she return using AP at POE..so AP is must at this point as her AOS is still pending...
Also get advice from your lawyer in advance..
Thanks for your advice Webm...I will contact a lawyer as well. So what will be her visa status when she comes back to USA? Her H-4 is invalid now as I got my G.C. She has no EAD yet. Will she get into trouble assuming she travels with her AP?

Dear Attorney,
My company is willing to sponsor me and I have a few questions regarding the occupation.
I have no professional degree but I have 7 years experience as a general manager. My boss spoke to one attorney who said that I can be in EB-3 skilled worker but he (the attorney) is going to put that at least 5 years experience is required. The company that I have been working for is an export/import Asian food company (65 employees; $100 million revenue) so my boss is not going to hire someone who has only 2 years experience. The attorney also wants to put that a foreign language (Korean) is required as I will be responsible for making orders from Korea.
On the other hand I went to a different lawyer who said that if I want to be in EB-3 skilled worker the 2 years experience is enough and if there will be a foreign language requirement, most likely my ETA9089 will be denied. Also, he mentioned that a GENERAL MANAGER requires at least a bachelor's degree (as stated in SWA OES).
I would appreciate your input.

I applied on 7/26 for seventh year H1-B renewal and extension of stay. I concurrently filed I-539 for Extension of Stay for family. Six years of H-1 and related I-94 expired on 10/8 and since then I have been working under the 240 day grace period rule.
Here are some other facts:
- I have an approved I-140 filed and approved back in 2007
-I-485 was filed during the 2007 July-August wave
-I do have an EAD valid until November 2011 but I have never used it. I have always maintained my H-1 status.
-My wife also has an EAD that expires end of this week. I-765 Application to renew her EAD was filed more than 75 days ago for which we requested an expedite request. She has never worked before although her first EAD was approved three years ago.
My questions:
1. What happens if USCIS denies my employer's petition for H-1b extension? Will I be out of status immediately after? Does having an EAD provide me any insulation?
2. What about other people here those who are working on EAD? How are they maintaining their status? Are they required to file extension of stay application?
3. Do you think approval of my wife's EAD renewal is tied to the pending I-539?

No, you can not work on 1099 for any other company.
Yes, the only option is work on cash.
I am currently on H1..working for company A..
Can i work for another company...without transferring my H1 and can i get a 1099 Misc....( they cannot run my payroll as i wont be employed with them)....the work is in the same field...

I am trying to get a green card for the US. My parents are from east asia and I was born in Canada. I went to University in Maryland from 1992-96 and obtained my dental license. I am licensed in the US and intend to purchase a dental office soon. I will still be keeping my dental office in Canada for at least 1 year once I am able to work in the US. I heard about a investment visa however I am not investing more than $400k but it will employ at least 4 US nationals(ctizens). Can I still use the investment visa or can I get a visa for opening a secondary dental office in the US and still keep my existing office in Canada until I qualify for a green card. My attorney filed my EAD (mailed) on August 28 this year and last Friday I saw the approval too on USCIS site. Today I decided to help one of my friends with his EAD so I decided to pull the attorney filed copy of my I-765, I noticed that attorney had mentioned "AOS" in Q:15 instead of H1B. I am on H1B and I have never used my EAD... so I am worried now and I don't know what are my options now... Would you please take few minutes of your precious time and help me with the options I may have now to correct this issue?

I am working on H1-b visa. My green card stage: Priority date July '06, EB3, India. I-140 approved, I-485 filed Sept'07. I don�t intend to use EAD for employment now.
I have a need to get my future spouse on H-4 visa. With EB3 India priority dates retrogressed, filing dependent I-485 for spouse is years away. (Unless rules change!)
Question 1: IF I loose my H1-b status (job loss) and find a new job using my EAD, my spouse on H-4 goes out of status. So what all options do I have to keep her in a valid status?
Question 2: Proactively, say my spouse (when on valid H-4 status) starts a Masters program (part-time) at a University, can she file for a H4 to F-1 change of status (COS) that very week or month I loose my job. Or are there any serious timing issues in this option?

It is not an issue for people of Indian origin who are returning, of planning to return, back to India for whatever reason. They are the lucky (?) ones to have either a Indian passport or PIO card or OCI card so they are eligible to work on that basis.
But how about those who do not qualify for one of the above? There is an increasing number of foreigners working in India - how do they become eligible to work in India? Is there an equivalent of an H1B, or may be oneday GC & Citizenship?

It wouldn't hurt your GC process or your status even if your employer revokes your approved I-140. If you are so worried then check this info from USCIS - http://www.uscis.gov/files/pressrelease/I140_AC21_8403.pdf

I applied my labor as Software Engineer and BEC approved it with a code of Mechanical Engineer. I got it changed, but took me a year though. They kept my change request until the end when they were ready to shutdown BEC.

if you can go to biometric center within 10 days of original appointment and do a walk-in on a walk-in date, usually WED;

go to biometric center and hand over the originals (after keeping a copy) and ask them to reschdule and give them for ex., any date after 25th OCT 2007.

U R better off rescheduling your mexico appointment - its something that could be done within next 3 to 4 months for sure. The problem of rescheduled FP is, it kind of throws your case in the back and based on ASC's load, it might take them upto an year or more (think 800,000) for them to put you in again.
Its just my opinion based on my conversation with my lawyer - since we were in S. Africa and my lawyer notified me about the FP and my lawyer blurted out what I said above.
